HA Academy Terms of Service

Welcome to HA Academy’s online store! These Terms of Service govern your use of our website, services, products, and participation in programmes organised under HA Academy and HA Adventure. By accessing our website or enrolling (as a participant or on behalf of the participant) in any programme, you agree to be bound by these terms. Please read them carefully.
1. General Conditions
• Programmes offered on this Site are delivered by HA Academy Pte. Ltd. and HA Adventure Pte. Ltd. The website and online checkout are operated by HA Launchpad Pte. Ltd. Personal data collected through this Site may be accessed and used by these affiliated entities for purposes including programme delivery, customer support, communication, marketing and fulfilment.
• By accessing and using our website, you represent that you are at least the age of majority in your jurisdiction or have given us your consent to allow any of your minor dependents to use this site.
• We reserve the right to refuse service to anyone for any reason at any time.
2. Account Registration
• To access certain services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account and password.
• You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary.
3. Products and Services
• All descriptions of products, programmes, services and pricing are subject to change at any time without notice, at our sole discretion.
• We reserve the right to discontinue any product, programmes or service at any time.
• We make every effort to display as accurately as possible the colours and images of our products. However, we cannot guarantee that your device’s display of any colour will be accurate.
4. Pricing and Payments
• All prices are listed in Singapore Dollars (SGD) and are subject to change without notice.
• Payment for products, programmes and services must be made through the available payment methods on our Shopify store. By placing an order or making a booking, you authorize us to charge the applicable payment method for the total amount of your order, including any taxes and shipping fees.
• Once a booking is confirmed by payment, no cancellations or refunds will
be given, including cases of late arrival or early departure from the
programmes, except as expressly stated under “5. Programme
Cancellation”.
5. Programme Cancellation
• HA Academy and HA Adventure reserve the right to cancel any programme due to insufficient enrolment, unforeseen circumstances, or events beyond our reasonable control.
• In the event of a programme cancellation, participants will have the option to receive a full refund or transfer their booking to another date of the same programme, subject to availability.

6. Changes to booking
• Requests to change bookings, transfer to another date of the same programme, or to another participant may be made at no extra cost, subject to availability.
• All requests must be submitted in writing or online at least 5 working days before the programme start date.
• No replacement, refund, or rescheduling will be provided if a participant is unable to attend due to illness or personal reason on the actual programme day.
7. Liability, Assumption of Risk and Indemnity
Assumption of Risk
• Participation in programmes may involve physical, outdoor, or movement-based activities that entail inherent risks, including personal injury, property loss or damage, or in rare cases, serious harm. You acknowledge and accept these risks on behalf of the participant, whether activities take place on our premises or off-site.
Limitation of Liability
• To the fullest extent permitted by law, HA Academy, HA Adventure, and our staff, agents, contractors, volunteers, and representatives shall not be liable for any loss, damage, injury, or death, except where caused by gross negligence or wilful misconduct.
• Without prejudice, HA Academy and HA Adventure’s total liability (if any) for any claim or series of connected claims arising out of or relating to the camp or programme or these terms shall in no event exceed the total fees paid by you for that camp or programme.
• HA Academy and HA Adventure shall not be liable for any special, incidental, indirect, consequential or punitive damages (including loss of opportunity, loss of income, reputational loss, or any other indirect loss), whether in contract, tort (including negligence), statute or otherwise, even if advised of the possibility of such damages.
Indemnity
• You agree to indemnify and hold harmless HA Academy, HA Adventure, and our staff, agents, contractors, volunteers, and representatives from and against all claims, demands, actions, liabilities, costs and expenses (including legal costs on an indemnity basis) arising out of or in connection with:
a. any breach by you or the participant of these terms;
b. any wilful act, negligence, misconduct or omission by you or the participant;
c. any damage or injury caused by the participant to third parties or to property during the programme.
8. Participant Behaviour
• Participants are expected to follow the programme rules and instructions while under our supervision.
• If a participant’s behaviour significantly affects the safety and well-being of others, we reserve the right to exclude that participant from the programme.
• In such cases, no refunds will be issued, and all travel costs will be borne by the participant.
9. Punctuality
• Timely arrival and pick-up of participants are mandatory. In cases of unforeseen delays, please inform our team as soon as possible.
10. Health, Safety and Insurance
• The health and safety of all participants is our priority. Participants are responsible for their own Accident and Medical Insurance coverage.
• In the event of an accident, our staff will administer first aid and contact emergency services if necessary.
11. Allergies and Medical Information
• All medical conditions, allergies, and/or other restrictions must be fully disclosed during registration.
• HA Academy and HA Adventure shall not be liable for incidents arising from undisclosed or inaccurate information.
12. Data Protection and Marketing Consent
• By enrolling in our programmes, you consent to HA Academy and HA Adventure:
(a) capturing photographs and videos during the programmes for promotional and marketing purposes. HA Academy and HA Adventure retain full copyright ownership of all such media, and no compensation will be payable.

13. Intellectual Property
• All content on this website, including but not limited to text, graphics, logos, images, and software, is the property of HA Academy or our content suppliers and is protected by applicable intellectual property laws.
• You may not reproduce, distribute, or exploit any content on our website without our prior written permission.
14. User-Generated Content
• If you submit any content to our website (e.g., reviews, comments), you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and publish such content in any media.
• You agree not to submit any content that is unlawful, offensive, or infringes on the rights of others.
15. Prohibited Activities
• You agree not to engage in any activity that could harm or interfere with the operation of our website, including but not limited to hacking, spamming, or transmitting viruses.
• You agree not to use our website for any illegal or unauthorized purpose.
16. Governing Law
• These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of Singapore.
